Joe Miller Law is a law firm dedicated to protecting the rights of seriously injured workers (workers compensation) and people seriously injured in car accidents in both Virginia and North Carolina. What is your typical process for working with a new customer?
If we decide the to accept your claim, especially as to workers comp matters, our first priority is to determine if your case is either a "green check mark" or a "red exclamation point." Some cases are really emergencies from the outset. Something needs to be addressed, or you may lose important rights. Others, such as accepted claims that are under an Award, are also very important, but not emergencies. Once we determine the status, appropriate action will be taken, whether it involves filing a Claim for Benefits, ordering critical medical records, or filing a Motion to make something happen.
What education and/or training do you have that relates to your work?
Joe Miller received a Bachelor of Science from Emory University in 1984. He received his J.D. degree from the Marshall-Wythe School of Law at William and Mary in 1987. He has been a member of the Virginia Bar since 1988, and a member of the North Carolina Bar since 1994.
Do you have a standard pricing system for your services? If so, please share the details here.
We typically take cases on a contingency fee basis. As to workers compensation, the typical attorneys fees approved are 20% of the gross settlement by the Virginia Workers Compensation Commisison and 25% of the gross settlement by the North Carolina Industrial Commission. Sometimes, there are much smaller, additional fees if we have to go to hearing or perform significan work on your claim. These must be approved by the respective Commission.
On personal injury/car accident cases, our fees are typically 33.3% of your recovery, unless the injured person is a minor, in which case they are 25%. If we have to litigate the matter, the fees increase to 40% of the recovery.
In either event, you will not have to stroke a check.
How did you get started in this business?
I began working with my late father, Bernard Miller, Esq., who was a well-known trial attorney in Virginia. He and his partner, Walt Bondurant trained me in my early years of practice representing injured railroad workers.
Although these days I am not usually priviledged to represent railroad workers, I have retained my passion for representing injured workers and I now represent folks hurt at work in a variety of industries, from factories, to construction, to nursing assistants.
What types of customers have you worked with?
Our typical client is severely injured, meaning their injuries will usually require some type of surgery, and most of the time, the client's injuries are severe enough that the lasting effects will prevent them from being able to return to their former occupation.
Most of the folks we represent are involved with manual labor, meaning they have to use their physical strength to effectively perform their job.
Our job is to obtain enough money for them so they can comfortably transition to another job that suits their new physical limitations, or in the most severe cases, that will last they reach retirement age.
Describe a recent event you are fond of.
We recently won a case for a young man who had one of his legs chopped off above the knee in a work accident. On top of his injuries, he was getting no money and had hundreds of thousands of dollars in medical bills hanging over him. We were able to turn it all around for him, and now he has ongoing pay and his medical bills are all taken care of, for life.
What advice would you give a customer looking to hire a pro in your area of expertise?
DO NOT, under any circumstances, think you can handle this on your own. Every day, we turn down so many cases, mainly because the injured worker thought they were smart and could make the right decisions about their case, not realizing that their decision basically ruined any chance they had for a decent resolution to their case.
Remember that when you are severely injured and in pain, you are not thinking clearly. You need to rely on a team that has done this thousands of times and knows what you are going through.

What questions should customers think through before talking to pros about their needs?
Are you already receiving workers comp checks? Are you under an AWARD from the Workers Comp Commission? This is not the same as an Award AGREEMENT. That piece of paper means nothing until it is converted into an Award by the Commission. It is very important to figure this out, because if you are not under an Award, you really have no rights at all, and your checks could be cut off at any time.
