Initial consultation is key.  I carefully evaluate the client's initial needs and anticipated work.  I then provide counsel and guidance as to how various intellectual property protections are implemented, where they may be applicable to the client's needs, and a budget estimation as to how to accomplish those goals.  Most IP protections require some time (> 1 year) to procure.  I stay involved with the client in all the above respects until that protection is secured.

I am an ex-Electrical Engineer/software developer, and I worked at AT&T Bell Labs for 4 years prior to becomming a patent attorney. I have an M.S.E.E. from Michigan, a B.S.E.E. from Penn State and my law degree is from NYU.  I have worked with some of the largest IP firms in NY City and have 10 years of large corporate legal experience with Nokia and Siemens. I have represented 10's of start-up companies, and I have managed the procurement of 1000's of patents and trademarks on behalf of my clients.

I have fixed fee arrangements for trademark filings and other routine business and IP filings. Once filed, proseuction of trademarks is dependent on time and the complexity of the issues raised by the Examining Attroney during the examination process. Many trademarks are obtained without significant prosecution if the proper work and counsel is provided up front.

Patent preparation and prosecution is hourly with estimates provided at each stage of the filing and prosecution processes.  Many of the routine submissions surrounding the core work can be done fixed fee.

Obtaining Patents and Trademarks is a much more complicated process than most people realize and most attorneys advertise. There is much more to the consideration of a proper attorney to handle these matters than the fixed-fee or hourly rate offered by the counselor/practitioner.
